Terms and Conditions.
The patterns and designs created by Emma Hamilton of Emma Hamilton Designs are the intellectual property of Emma Hamilton. The copyright to the artwork is owned by Emma Hamilton.
License terms are available for 2 or 5 years, as chosen by the client at the time of purchase. If the client decides to change the license term, an additional charge may be applied for extending the term, or a refund may be provided for shortening the term. The purchased license for this artwork is applicable worldwide and is not restricted to the country of origin.
To purchase a licence for a pattern, design or artwork, you must:
1. Add the pattern, design or artwork to the cart. Note that you are purchasing a limited licence in the pattern, design or artwork, not the pattern itself.
2. Complete the short form regarding your intended use of the pattern, design or artwork.
3. Read and agree to the Licence Terms and Conditions.
4. After agreeing to the terms and conditions, proceed to check out and pay the licence fee. Payment of the fee represents an offer to purchase the licence; it is a pending order only and does not guarantee that the licence will be granted.
5. Upon receiving notification of your payment, a confirmation email with the receipt of purchase, terms of purchase and expected delivery time for the file will be sent.
6. If you decide not to proceed with the purchase before receiving the file, please email directly for a full refund. No refunds will be available once the file has been sent and received.
7. The licence will commence from the date the pattern, design or artwork was sent, as detailed in the confirmation email.
I, Emma Hamilton, reserve the right to decline any order for a Pattern, Design, or Artwork license at my discretion. In such cases, a full refund will be issued.
Use of the Pattern, Design, or Artwork outside of the specified business or industry is subject to written approval from Emma Hamilton. A secondary charge may apply at the discretion of Emma Hamilton.
Upon obtaining the design file, please adhere to the following guidelines:
1. The Pattern, Design, or Artwork must not be altered or modified in any way.
2. The file is prohibited from being sold to third parties or other businesses.
3. Sharing the file with individuals outside of the business is strictly forbidden.
4. The Pattern, Design, or Artwork must only be used within the specified business or industry.
You are entitled to extend the license term until one month after the conclusion of the current license period.
Once the license term has expired, the pattern, design, or artwork cannot be used further. Manufacturing or producing products, or releasing new products with the pattern, design, or artwork is prohibited after the license expires. Remaining stock with the pattern, design, or artwork that was produced during the license term may be sold for 6 months beyond the expiration date of the license.
In accordance with Australian Consumer Law, if there is an issue concerning the pattern, design, or artwork, Emma Hamilton may provide either a replacement or a refund at her discretion.
If it is discovered that the Pattern, Design, or Artwork has been used or handled in a way that breaches these Terms or any applicable License Agreement, actions may be taken in response.
I am not liable for any outcome or success of products using the Pattern, Design, or Artwork. No guarantees are made regarding result, quality, or profitability. This includes merchantability or aesthetics.
I am not responsible or liable for any loss, damage, or injury caused by products or items with the applied Pattern, Design, or Artwork.
Please note that I am not liable for variations in colours or quality due to:
1. Differences in display settings on various devices and computers.
2. Variations arising from manufacturing processes, production techniques, equipment, industrial methodologies, and material properties.
